1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the mobile application Noctryn: After Dark (the “Application”), operated by Noctryn Games Inc. (“Noctryn,” “we,” “our,” or “us”).

By downloading, accessing, or using the Application, you agree to be legally bound by these Terms.

If you do not agree, you must not use the Application.

2. Eligibility & Age Requirement

The Application is strictly intended for adults.

You must:

  • Be at least eighteen (18) years of age; and

  • Be of legal drinking age in your jurisdiction.

By accessing or using the Application, you represent and warrant that you meet these requirements.

You further represent that all participants in any gameplay session are adults and meet the legal drinking age requirement in their jurisdiction.

Misrepresentation of age constitutes a material breach of these Terms.

3. Alcohol & Responsible Play Disclaimer

The Application is a social entertainment game. Consumption of alcohol is optional.

Noctryn Games Inc.:

  • Does not encourage excessive alcohol consumption

  • Does not require alcohol consumption

  • Encourages responsible participation

  • Permits substitution with non-alcoholic beverages

You assume full responsibility for your actions, behavior, and consumption decisions.

Noctryn Games Inc. shall not be liable for:

  • Alcohol-related injury

  • Intoxication

  • Accidents

  • Property damage

  • Personal injury

  • Legal consequences

  • Harm arising from user conduct

Participation is voluntary and at your own risk.

4. Adult Content & Consent

The Application contains mature themes, including adult language and references to consensual kink or relationship dynamics.

All gameplay and interactions must be:

  • Voluntary

  • Legal

  • Consensual

  • Between adults

Noctryn Games Inc. does not condone harassment, coercion, abuse, or unlawful conduct.

We are not responsible for actions taken by users during or after gameplay.

You assume full responsibility for ensuring that all participation is consensual and lawful.

5. User Conduct

You agree not to:

  • Use the Application for unlawful purposes

  • Copy, reproduce, distribute, or exploit content

  • Record or commercially redistribute gameplay content

  • Attempt to reverse engineer or extract Application content

  • Use the Application in violation of applicable laws

Noctryn Games Inc. reserves the right to restrict access for violations of these Terms.

6. Subscriptions & Free Trial

6.1 Subscription Access

The Application offers:

  • A seven (7) day free trial

  • Weekly subscription

  • Monthly subscription

Premium content (including but not limited to Edge, Chains & Whips, Dungeon, and Excite Me decks) requires an active subscription.

The Vanilla deck remains free.

6.2 Free Trial

If you enroll in a free trial:

  • You will receive full access during the trial period.

  • Your subscription will automatically convert to a paid subscription unless canceled before the trial ends.

6.3 Auto-Renewal

Subscriptions automatically renew unless canceled prior to renewal through your Apple App Store or Google Play account settings.

Deleting the Application does not cancel your subscription.

6.4 Billing & Refunds

All payments, billing, cancellations, and refunds are handled exclusively by Apple App Store or Google Play.

Noctryn Games Inc.:

  • Does not process payments directly

  • Does not issue refunds directly

  • Does not provide refunds directly

Pricing is subject to change. Price changes may apply to future billing cycles in accordance with platform policies.

7. Intellectual Property

All content within the Application, including but not limited to:

  • The name “Noctryn”

  • The title “Noctryn: After Dark”

  • Deck names

  • Card text

  • Structure and format

  • Graphics and branding

are the exclusive property of Noctryn Games Inc.

You may not reproduce, distribute, modify, or commercially exploit any content without express written permission.

8. Modification of Application

Noctryn Games Inc. reserves the right to:

  • Modify decks

  • Add or remove features

  • Change content

  • Adjust subscription structures

  • Update pricing

at any time without prior notice.

9. Limitation of Liability

To the maximum extent permitted by law:

Noctryn Games Inc. shall not be liable for indirect, incidental, consequential, special, or punitive damages.

In no event shall Noctryn Games Inc.’s total liability exceed the amount paid by you to Noctryn Games Inc. in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Noctryn Games Inc., its directors, officers, and affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Application

  • Your conduct during gameplay

  • Violation of these Terms

  • Violation of applicable laws

11. Arbitration & Class Action Waiver

Any dispute arising from these Terms shall be resolved through binding arbitration in Ontario, Canada.

You waive the right to participate in any class-action lawsuit or class-wide arbitration.

Arbitration shall be conducted on an individual basis.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

13. International Users

You are responsible for compliance with the laws of your jurisdiction.

If use of the Application is unlawful in your region, you must not use it.

14. Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and Noctryn Games Inc. regarding the Application.

16. No Warranties

The Application is provided on an “as is” and “as available” basis.

Noctryn Games Inc. makes no warranties, express or implied, including but not limited to:

  • Fitness for a particular purpose

  • Availability or uninterrupted access

  • Accuracy or reliability of content

Use of the Application is at your own risk.

17. Access & Availability

We do not guarantee that the Application will always be available or error-free.

We may:

  • Suspend access

  • Restrict availability

  • Perform maintenance without notice.
